These Terms of Service (“Terms”) govern your access to and use of https://www.ogtss.net and related services provided by Online Golf Tournament Scoring System (“OGTSS,” “we,” “us,” or “our”). By accessing or using the platform, you agree to be bound by these Terms.

By submitting content, you grant OGTSS a non-exclusive, royalty-free, worldwide license to use, host, store, display, reproduce, and distribute that content as needed to operate and improve the service.

OGTSS may remove or restrict content that violates these Terms, applicable law, or the rights of others.

6. Prohibited Conduct

You agree not to:

• Use the platform for any unlawful purpose or in violation of these Terms;
• Post or transmit content that is harmful, abusive, defamatory, obscene, or otherwise objectionable;
• Interfere with or disrupt the operation of the site, servers, or networks;
• Attempt to gain unauthorized access to accounts, systems, or data;
• Use automated scripts, bots, scrapers, or similar tools to access or extract data without our prior written permission;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

7. Termination

OGTSS may suspend or terminate your access to the platform, in whole or in part, at our sole discretion, with or without notice, if we believe your conduct violates these Terms, harms other users, or creates risk or liability for OGTSS. Upon termination, your right to use the service ceases immediately.

8. Intellectual Property

The OGTSS website, software, branding, logos, and all content owned or licensed by OGTSS (excluding User Content) are protected by intellectual property laws and remain the property of OGTSS or its licensors. You may not copy, modify, distribute, sell, or create derivative works from our materials except as expressly permitted by these Terms or with our prior written consent.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. OGTSS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT WILL BE ACCURATE OR RELIABLE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OGTSS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Illinois, unless applicable law requires otherwise.
